Most vacations run smoothly without any major incidents occurring. But occasionally things do go horribly wrong, turning your dream holiday into a nightmare and leaving you out of pocket on top of everything else.

In that situation, it is well worth finding out if there is a class action suit that you can join. If there is you stand a very good chance of receiving some compensation. At least enough cash to enable you to book another holiday, so that you can recover from the disastrous one you just had.

First, let’s define what the term ‘class action’ actually means. According to Wikipedia, a class action (aka class-action lawsuit, class suit, or representative action), is a type of lawsuit where one of the parties instituting legal action against a wrongdoer is comprised of a group of people who are represented collectively by a member of that group. The class action originated in the United States but several European countries also allow consumer organizations to bring claims on behalf of consumers.

Here are some tips to help you to follow this particular legal path to receiving compensation.

Gather as much evidence as possible

Regardless of the nature of the incident that causes your loss of holiday enjoyment, try to gather as much evidence as possible and keep it in a safe place. Take photos, make notes of times, dates and conversations. These are all things you can potentially use to bolster your case. If you are hoping to pursue a claim via a class action, rather than going it alone, having evidence to hand will make it far easier for you to do so. The chances are that if you bring evidence to the table that will strengthen everyone’s case you will be welcomed with open arms.

Stay in touch with others who were affected as you were

If you are on a package tour and know that others are affected by the incident, keeping a record of their contact details could prove useful. With their permission, you can use those details to check in with them when you get home to find out if they are taking legal action. If they are working with a class-action lawyer you may be able to join forces and make a claim together.

Holiday disasters are quite widely reported in the press. For example, you see stories about Norovirus outbreaks onboard cruise ships all the time. Often these stories have been given to the press by disgruntled passengers or other kinds of holidaymakers who are in the process of suing. Sometimes you will see their full name used or the name of their solicitor mentioned in the article. This provides you with the chance to go online and try to find them. When you do, it does no harm to see if you can join forces to take legal action together.

These sites list the various class-actions that they know about and explain how you can join them if you have been affected in a similar way. A lot of these sites also provide people with a way of starting their own class action. They make it really easy for you to connect with people who are in a similar situation as you and find lawyers who have the right level of expertise.
